Terms of Use
Draft. These terms are being prepared for WorthGrove’s public launch and are under legal review. Questions: support@worthgrove.app.
- WorthGrove is a planning tool. It isn’t financial, tax or legal advice, and its plans and dates are estimates. You make your own financial decisions.
- WorthGrove does not move money, pay bills, or lend money. You stay in charge of every payment.
- WorthGrove Plus renews automatically until you cancel. A free trial turns into a paid subscription unless you cancel at least 24 hours before it ends.
- You use WorthGrove at your own risk. To the fullest extent the law allows, Chronicles of Mom Life and everyone who works with it are not responsible for losses from using, misusing, or errors in the app (sections 13–15).
1. Agreement
These Terms of Use (“Terms”) are a binding agreement between you and Chronicles of Mom Life (“Chronicles of Mom Life”, “we”, “us”, “our”) for using WorthGrove: the iPhone and Android apps, the web app, worthgrove.app, and related services (together, “WorthGrove”). By creating an account, starting a free trial, buying a subscription, or otherwise using WorthGrove, you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use WorthGrove.
In these Terms, the “WorthGrove Parties” means Chronicles of Mom Life and WorthGrove, and their past, present and future owners, members, managers, officers, directors, employees, contractors, agents, representatives, affiliates, successors, assigns, licensors and service providers.
2. Who can use WorthGrove
You must be at least 18 years old (or the age of majority where you live, if older) and able to form a binding contract. WorthGrove is offered in the United States. You may use it only for personal, household and non-commercial purposes.
3. A planning tool, not financial advice
- WorthGrove provides general tools to organize information you enter. It does not provide financial, investment, tax, accounting, credit, debt-management or legal advice, and is not a bank, lender, money transmitter, credit-repair organization, debt-relief, debt-settlement or credit-counseling service, or fiduciary. Nothing in WorthGrove is a recommendation suited to your situation. Talk to a qualified professional before making significant financial decisions.
- Debt-free dates, payoff plans and order, interest totals, savings, paycheck plans, “left after bills” amounts, budgets, reports and all other figures are estimates calculated from what you enter. They may be incomplete or wrong, and your lenders’ actual interest, fees and minimum payments may differ. You are responsible for checking every figure against your own statements and records.
- WorthGrove does not make, schedule or guarantee payments. Marking a bill paid in WorthGrove only records it; it doesn’t pay it.
- Reminders are a convenience and may be late, early, wrong or not delivered. You remain solely responsible for paying your bills and debts on time, and for any late fees, penalties, interest, overdrafts, collections or credit effects.
4. Your account
You sign in with a one-time code emailed to you. Keep access to your email secure, because anyone who can read it can sign in as you. You are responsible for all activity on your account. Tell us right away at support@worthgrove.app if you think someone has accessed your account.
5. Households and sharing
- A household’s owner can invite others with a one-time code, remove members and hand ownership to another member. Only share codes with people you trust: everyone in a household can see and change its shared information, including deleting it.
- Your personal ledger is private to you. Leaving or being removed from a household deletes your personal ledger in it; shared household history stays with the household.
- You are responsible for what you and the people you invite do, for disputes among household members, and for having the right to share any information you add about others. The WorthGrove Parties are not responsible for any household member’s actions.
6. Your information
You own the information you put into WorthGrove, including documents you upload (“Your Content”). You give us a limited, non-exclusive, royalty-free license to host, store, copy, process and display Your Content only to provide WorthGrove to you and your household, as described in the Privacy Policy. You are responsible for Your Content and for keeping your own copies of anything important. WorthGrove is not a records-retention or document-safekeeping service: keep the originals of important papers (such as titles, tax records and policies), because files can be deleted by you or any member of your household, and may be lost. Only upload documents you have the right to share with your household, and don’t upload anything unlawful. You can download your information or delete your account at any time.
7. Acceptable use
Don’t misuse WorthGrove. For example, don’t: access or try to access other people’s households, accounts or data; guess or share invite codes with people outside your household; probe, scan or test its security; interfere with, overload or disrupt it; use bots or scrapers; copy, modify, resell or reverse-engineer it, except where the law allows; upload malware; impersonate anyone; or use it for anything unlawful, fraudulent or harmful.
8. WorthGrove Plus subscriptions
8.1 Plans and prices
WorthGrove’s core features are free. WorthGrove Plus is an optional paid subscription that adds features such as family sharing, personal ledgers and other features described in the app. Plus is offered as a monthly plan (currently US $5.99 per month) or an annual plan (currently US $49.99 per year), plus any applicable taxes. Current prices, and what Plus includes, are always shown in the app before you buy; if they differ from these Terms, the in-app offer you accept controls. Plus covers your whole household for as long as the subscription that pays for it stays active.
8.2 Founding Family offer
For a limited time, the first 1,000 annual subscribers may be offered the “Founding Family” annual price (US $39.99 per year). The Founding Family price stays the same at each renewal for as long as that subscription renews without interruption. If the subscription is cancelled and lapses, is refunded, or is switched to another plan, the Founding Family price ends and can’t be restored. We decide eligibility, and the offer may end at any time.
8.3 Free trial
New subscribers may be offered a 14-day free trial, once per person and per household. Unless you cancel at least 24 hours before the trial ends, your subscription will automatically begin and you will be charged the plan price shown when you started the trial, then on each renewal. If you cancel during the trial, you won’t be charged, and Plus ends when the trial ends.
8.4 Automatic renewal
YOUR SUBSCRIPTION RENEWS AUTOMATICALLY AT THE END OF EACH MONTHLY OR ANNUAL PERIOD, AND YOUR PAYMENT METHOD WILL BE CHARGED THE THEN-CURRENT PRICE PLUS ANY TAXES, UNTIL YOU CANCEL. Renewal charges are made within the 24 hours before the current period ends. By subscribing, you authorize these recurring charges. Where the law requires, we will send you a reminder before an annual subscription or a free trial converts to a paid subscription, and a confirmation of your subscription terms and how to cancel.
8.5 How to cancel
You can cancel at any time, and cancellation takes effect at the end of the current paid period (or trial). You keep Plus until then.
- iPhone (App Store): Settings → your name → Subscriptions → WorthGrove → Cancel Subscription.
- Android (Google Play): Play Store → profile icon → Payments & subscriptions → Subscriptions → WorthGrove → Cancel.
- Web: More → Account Settings → Manage subscription in WorthGrove, which takes you to our payment processor’s page where you can cancel online in a few steps.
Deleting the app or your WorthGrove account does not cancel a subscription bought through the App Store or Google Play; cancel it there as well. You can also email support@worthgrove.app for help cancelling.
8.6 Refunds
Except where the law requires otherwise, payments are non-refundable and we don’t give refunds or credits for partial periods or unused features. Purchases through the App Store or Google Play are refunded only by Apple or Google under their policies (Apple: reportaproblem.apple.com; Google: the Google Play refund page). For web purchases, contact us within 14 days of a charge and we’ll review the request in good faith. Residents of states with different legal requirements receive the refund rights their law provides.
8.7 Price changes
We may change subscription prices. We will tell you at least 30 days before a price increase applies to you (or longer if the law or the store requires), and it will apply at your next renewal after that notice. Where required, the store will ask for your consent before charging a higher price. If you don’t agree to the new price, cancel before it takes effect.
8.8 Store purchases and billing
Subscriptions bought through the App Store or Google Play are also governed by Apple’s or Google’s terms, and those stores (not us) handle the charges, payment methods, and billing problems. You are responsible for keeping your payment information current; if a payment fails, the store or our processor may retry it, and Plus may be suspended until payment succeeds. You are responsible for all applicable taxes.
8.9 When Plus ends
If Plus ends (because you cancelled, a payment failed, or a refund was issued), nothing you entered is deleted. Plus features stop: personal ledgers become read-only, new household invitations can’t be created, and other Plus-only features are turned off. Existing household members keep access to the shared household. Plus returns, with everything you entered, if you subscribe again.
8.10 Beta testing
Before subscriptions launch, or from time to time, we may offer Plus features to testers at no charge. Free access may end at any time without notice, and these Terms still apply.
9. Changes to WorthGrove; ending your use
WorthGrove is evolving. We may add, change, suspend or discontinue features, or WorthGrove itself, at any time. If we discontinue WorthGrove Plus or WorthGrove entirely, we will give reasonable notice and a pro-rated refund of any prepaid, unused web subscription period, and we will tell you how to request refunds for App Store and Google Play purchases. We may suspend or end your access if you violate these Terms, if the law requires, or to protect WorthGrove or others. You can stop using WorthGrove and delete your account at any time.
10. Our content and feedback
The WorthGrove name, logo, illustrations, design, text and software belong to Chronicles of Mom Life or its licensors and are protected by law. We give you a personal, limited, revocable, non-exclusive, non-transferable license to use WorthGrove under these Terms. If you send us ideas or feedback, we may use them freely without any obligation to you.
11. Third-party services
WorthGrove relies on third-party services (such as app stores, payment processors, email and notification providers, and hosting). The WorthGrove Parties are not responsible for third-party services, their availability, content, or actions, or for any third-party terms you agree to.
12. Assumption of risk
You understand and agree that you use WorthGrove at your own risk, that financial decisions carry risk, and that you alone are responsible for your financial decisions and their results, including decisions made using any estimate, plan, reminder, calculation or other information in WorthGrove, whether accurate or not.
13. Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, WORTHGROVE AND EVERYTHING IN IT IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND. THE WORTHGROVE PARTIES DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND THOSE ARISING FROM COURSE OF DEALING OR USAGE. THE WORTHGROVE PARTIES DO NOT WARRANT THAT WORTHGROVE WILL BE ACCURATE, COMPLETE, RELIABLE, SECURE, TIMELY, UNINTERRUPTED OR ERROR-FREE, THAT CALCULATIONS, ESTIMATES OR REMINDERS WILL BE CORRECT OR DELIVERED, THAT DEFECTS WILL BE FIXED, OR THAT YOUR INFORMATION WILL NOT BE LOST OR CORRUPTED.
14. Release and limitation of liability
14.1 Release. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU RELEASE AND FOREVER DISCHARGE THE WORTHGROVE PARTIES FROM ALL CLAIMS, DEMANDS, LOSSES, DAMAGES AND LIABILITIES OF EVERY KIND, KNOWN OR UNKNOWN, ARISING FROM OR RELATED TO WORTHGROVE, INCLUDING (A) ANY ERROR, INACCURACY, BUG, OMISSION, DELAY OR FAILURE IN WORTHGROVE, ITS CALCULATIONS, ESTIMATES, PLANS OR REMINDERS; (B) YOUR USE, MISUSE OR INABILITY TO USE WORTHGROVE; (C) YOUR RELIANCE ON ANYTHING IN WORTHGROVE; (D) THE ACTIONS OF HOUSEHOLD MEMBERS OR OTHER USERS; (E) UNAUTHORIZED ACCESS TO OR LOSS OF YOUR ACCOUNT OR INFORMATION; AND (F) THIRD-PARTY SERVICES. If you are a California resident, you waive California Civil Code §1542, which says: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.” You waive any similar law of any other state.
14.2 No liability. TO THE FULLEST EXTENT PERMITTED BY LAW, THE WORTHGROVE PARTIES WILL NOT BE LIABLE TO YOU OR ANYONE ELSE FOR ANY DAMAGES OF ANY KIND, WHETHER DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE, INCLUDING LOST MONEY, SAVINGS, PROFITS OR DATA; LATE FEES, PENALTIES, INTEREST, OVERDRAFT OR COLLECTION CHARGES; DAMAGE TO CREDIT; OR EMOTIONAL DISTRESS, ARISING FROM OR RELATED TO WORTHGROVE OR THESE TERMS, UNDER ANY THEORY (CONTRACT, TORT INCLUDING NEGLIGENCE, STRICT LIABILITY, STATUTE OR OTHERWISE), EVEN IF ADVISED OF THE POSSIBILITY OF THOSE DAMAGES.
14.3 Maximum amount. IF, DESPITE THE ABOVE, ANY WORTHGROVE PARTY IS FOUND LIABLE, THE TOTAL LIABILITY OF ALL WORTHGROVE PARTIES TOGETHER FOR ALL CLAIMS WILL NOT EXCEED THE AMOUNT YOU PAID US FOR WORTHGROVE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. IF YOU PAID NOTHING, THE WORTHGROVE PARTIES HAVE NO LIABILITY.
14.4 Where the law limits this section. Some states do not allow excluding certain warranties, releasing certain claims, or limiting liability for certain damages (for example, for gross negligence, willful misconduct, fraud, or personal injury, or under certain consumer-protection laws). In those states, the exclusions and limits above apply to the fullest extent that state’s law permits, and nothing in these Terms limits any right you have that cannot lawfully be waived. These limits are an essential part of our agreement; WorthGrove would not be offered, or would cost more, without them.
15. Indemnification
To the fullest extent permitted by law, you will defend, indemnify and hold harmless the WorthGrove Parties from all claims, losses, damages, liabilities, costs and expenses (including reasonable attorneys’ fees) arising from or related to: your use or misuse of WorthGrove; Your Content; your violation of these Terms or of any law or anyone else’s rights; and the actions of anyone you invite to your household or who uses your account. We may take control of the defense of any matter at our own expense, and you will cooperate.
16. Disputes
Before filing any claim, you agree to email support@worthgrove.app describing it, and to try in good faith for 60 days to resolve it informally. These Terms are governed by the laws of the State of [state to be confirmed], without regard to its conflict-of-law rules. Except where the law where you live requires otherwise, any dispute will be resolved exclusively in the state or federal courts located in [county and state to be confirmed], and you and we consent to their jurisdiction. Either of us may bring an eligible claim in small-claims court. To the fullest extent permitted by law, any claim must be brought within one year after it arose, or it is permanently barred.
17. Apple App Store additional terms
If you downloaded WorthGrove from the Apple App Store: (a) these Terms are between you and Chronicles of Mom Life only, not Apple, and Apple is not responsible for WorthGrove or its content; (b) your license is limited to using WorthGrove on Apple-branded products you own or control, as permitted by the App Store’s Usage Rules; (c) Apple has no obligation to provide maintenance or support for WorthGrove; (d) if WorthGrove fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for WorthGrove, and to the maximum extent permitted by law Apple has no other warranty obligation; (e) Apple is not responsible for any claims by you or a third party relating to WorthGrove, including product-liability claims, claims that WorthGrove fails to meet any legal or regulatory requirement, and consumer-protection or privacy claims; (f) Apple is not responsible for investigating, defending, settling or discharging any claim that WorthGrove infringes a third party’s intellectual property; (g) you represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and are not on any U.S. Government list of prohibited or restricted parties; (h) you must comply with applicable third-party terms when using WorthGrove; and (i) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Questions or complaints: support@worthgrove.app.
18. Google Play
If you downloaded WorthGrove from Google Play, your use is also subject to Google Play’s Terms of Service. Google is not a party to these Terms and is not responsible for WorthGrove.
19. General
- Changes to these Terms: we may update these Terms. We’ll change the date above, and for material changes we’ll tell you in the app or by email at least 30 days before they take effect. Continuing to use WorthGrove after that means you accept them. Changes to subscription prices follow section 8.7.
- Electronic communications: you agree to receive notices, disclosures and receipts electronically, in the app or by email, and that they satisfy any requirement that they be in writing.
- Entire agreement: these Terms, the Privacy Policy, and any in-app offer terms you accept are the entire agreement between you and us about WorthGrove.
- Severability: if any part of these Terms is found unenforceable, it will be enforced to the maximum extent permitted and the rest will remain in full effect.
- No waiver: if we don’t enforce a part of these Terms, that isn’t a waiver of our right to enforce it later.
- Assignment: you may not transfer these Terms. We may transfer them, for example as part of a merger, sale or reorganization, including to a successor company formed to operate WorthGrove.
- Events beyond our control: we aren’t responsible for delays or failures caused by events beyond our reasonable control, such as outages of internet, hosting, app-store or notification services, natural disasters, or government action.
- Survival: sections 3, 6, and 10 through 19 survive the end of these Terms or your account.
